            Appellant ex-husband and appellee ex-wife each challenged the judgment of the Circuit Court of Richmond (Virginia), which entered a final decree of divorce and an order distributing property between the parties.

            The Virginia Court made the following holding:

  • Va. Code Ann. § 20-107.3(E)(5) specifically instructs the court to consider the circumstances and factors which contributed to the dissolution of the marriage, specifically including any ground for divorce.
  • In weighing the equities of the parties, where the court finds proof of desertion, it may properly find such proof warrants a refusal to grant or reserve support. 
  • The court's decision to deny an award or reservation of support will be upheld where the court has considered the appropriate statutory factors, as delineated by Va. Code Ann. § 20-107.1. Where these factors are considered, the court's decision will only be reversed where there is a clear abuse of discretion.
