Jackson v. Jackson
Facts:
Plaintiff wife filed a bill of complaint for divorce. The trial court entered a final degree of divorce, awarding the wife a divorce on the grounds of willful desertion, granting the wife's request for a protective order against defendant husband, and memorializing its equitable distribution rulings. The Circuit Court of Richmond (Virginia) denied the husband's motion to reconsider. The husband appealed.

Holdings:

The Virginia Court made the following holding:

  • Unless it appears from the record that the trial court has abused its discretion, that it has not considered or has misapplied one of the statutory mandates, or that the evidence fails to support the findings of fact underlying its resolution of the conflict in the equities, the trial court's equitable distribution award will not be reversed on appeal.
