Norman v. Norman
Facts:

            The wife filed suit for a divorce 19 months after her marriage to the husband. Her action was premised on cruelty and reasonable apprehension of bodily harm. The Richmond court determined that the wife was not entitled to relief and dismissed her bill. She appealed from that decree. The court reversed the trial court's decree and rendered one that awarded the wife a divorce. The matter was remanded for further proceedings. The court noted that the evidence established that the husband frequently became intoxicated while in public with his wife. He also humiliated her with profanity and similar conduct while the couple was in the presence of their friends and relatives. The husband also struck or slapped the wife on several occasions. While the courts were reluctant to grant divorces simply because spouses were quarrelsome or temperamental, that reluctance was not an excuse for not granting a divorce when the evidence showed the requisite degree of cruelty. The court found that the evidence met that standard and that the wife was entitled to a divorce.

  • While the courts are, as they should be, reluctant to grant divorces simply because people have high tempers, quarrel with each other for slight or sufficient reasons and prove incompatible, it is nevertheless true that when the evidence shows cruelty, the injured spouse is entitled to the divorce authorized by Virginia law.
