<li> An unrevoked agreement for separation under which the spouses are living apart precludes either from obtaining a divorce for desertion. The rule, as stated, contemplates that the agreement must be unrevoked, and that the spouses must be living apart under the agreement, and there are certain modifications of the rule stated, as, for instance, that where the cause of action had fully accrued at the time of the agreement, the rule would not apply, and where the sole purpose of the agreement is to adjust the property rights of the parties the legal consequences flowing from the prior desertion are not affected. It is also stated that when the agreement is obtained without the real concurrence of the other party, it does not operate as a bar to divorce on the ground of desertion. The general rule is admitted, and while the courts do not commit themselves to the exceptions or distinctions stated, they do think the circumstances of each case determine, and should determine, the action of the court in passing upon a particular case.</li>

Appellee husband filed for divorce against appellant wife
while living in a foreign country during appellee's employment. Prior to trial,
appellee took a voluntary nonsuit but later filed for divorce once appellee
returned home in Richmond.
Appellant wife filed a motion to dismiss but the trial court ruled that
provisions restricting venue were not generally applicable to bar a divorce
suit under state law. Appellant objected to entry of a final divorce decree
which did not decide the property issues and argued that bifurcating the
distribution of marital property from the divorce decision violated the plain
language of Va. Code Ann. § 20-107.3(A). The court rejected appellant's claim
that Va. Code Ann. § 8.01-380, restricted appellee from bringing a suit for
divorce in the state because appellee had previously filed and nonsuited the
same cause of action in a foreign jurisdiction. The court held that the trial
court did err by granting the husband a final divorce and attempting to retain
jurisdiction to later adjudicate the equitable distribution issues without
having a joint motion of the parties and making a finding of clear necessity
due to the complexity of the property issues.<o:p></o:p></div>

consideration of all pensions, profit sharing or retirement plans in the
trial court's determination of spousal support. <o:p></o:p></li>

allegation that the husband deserted her, therefore her cross-bill for
divorce was dismissed, (3) the portion of the decree ordering custody and
support was proper, and (4) having been found without fault, the wife was
entitled to separate maintenance. The order of the trial court was

matrimonial duty, and is composed first, of the actual breaking off of the
matrimonial cohabitation, and secondly, an intent to desert, in the mind
of the offender. Both must combine to make the desertion complete. The
intent to desert is usually the principal thing to be considered.
Obviously a mere separation by mutual consent is not desertion in either.
Nor, as a matter of proof, can desertion be inferred against either from
the mere unaided fact that they do not live together, though protracted
absence, with other circumstances, may establish the original intent. The
courts have not laid down any particular rules of evidence for determining
whether a separation does or does not, as matter of proof, amount to
desertion; and the question does not admit of such rules, but each case
must rest on its own circumstances.<o:p></o:p></li>

for separation under which the spouses are living apart precludes either
from obtaining a divorce for desertion. The rule, as stated, contemplates
that the agreement must be unrevoked, and that the spouses must be living
apart under the agreement, and there are certain modifications of the rule
stated, as, for instance, that where the cause of action had fully accrued
at the time of the agreement, the rule would not apply, and where the sole
purpose of the agreement is to adjust the property rights of the parties
the legal consequences flowing from the prior desertion are not affected.
It is also stated that when the agreement is obtained without the real
concurrence of the other party, it does not operate as a bar to divorce on
the ground of desertion. The general rule is admitted, and while the
courts do not commit themselves to the exceptions or distinctions stated,
they do think the circumstances of each case determine, and should
determine, the action of the court in passing upon a particular case.<o:p></o:p></li>

The wife was committed to a mental hospital in Richmond,
and as a result, the parties lived separate and apart for more than two years.
The husband filed a complaint for divorce citing Va. Code § 20-91(9) as
grounds. The trial court granted the divorce and the wife, her guardian ad
litem, and committee appealed. On appeal, the court reversed and dismissed the
action for divorce, finding that the two year separation contemplated by Va.
Code § 20-91(9) did not apply to a situation where the separation was due to
the mental incompetence of one of the parties. The court found that by allowing
a divorce in that situation, it impliedly made mental incompetence a ground for
divorce. The court found that the separation contemplated by Va. Code §
20-91(9) was required to be of parties who were sufficiently competent to be
conscious of the fact that the act of separation had occurred. The court found
that because the wife was mentally incompetent she was not capable of knowing
that the separation had occurred.<o:p></o:p></div>
