Circuit Court of Richmond (Virginia), which awarded appellee husband a divorce,
and denied the wife alimony.

The
Virginia Court made the following holding:
- Mere coolness and denial
of sexual intercourse, where other marital duties are performed, do not
constitute cruelty or desertion in the sense used in the law of divorce.
- The court determined
that (1)the evidence failed to show that the wife permanently and
inexcusably refused sexual intercourse and therefore did not support a
finding of cruelty or constructive desertion and therefore the husband was
not entitled to a divorce, (2) there was no corroboration of the wife's
allegation that the husband deserted her, therefore her cross-bill for
divorce was dismissed, (3) the portion of the decree ordering custody and
support was proper, and (4) having been found without fault, the wife was
entitled to separate maintenance. The order of the trial court was
affirmed in part and reversed in part.
