            Appellant former husband sought review of the judgment of the Circuit Court of Richmond (Virginia) that granted the divorce from appellee former wife on grounds of cruelty, sanctioned him for his failure to comply with discovery orders in determining the equitable distribution, and awarded spousal support and attorney's fees.

            The Virginia Court made the following holding:

  • Va. Code Ann. § 20-103 states in part that in suits for divorce the court having jurisdiction of the matter may, at any time pending a suit pursuant to this chapter, in the discretion of such court, make any order that may be proper (i) to compel a spouse to pay any sums necessary for the maintenance and support of the petitioning spouse (ii) to enable such spouse to carry on the suit.
  • The determination whether a spouse is entitled to support, and if so how much, is a matter within the discretion of the court and will not be disturbed on appeal unless it is clear that some injustice has been done. In awarding spousal support, the court must consider the relative needs and abilities of the parties. It is guided by the nine factors that are set forth in Va. Code Ann. § 20-107.1. When the court does not quantify or elaborate on what weight or consideration it has given each factor, the court must examine the record to determine if the award is supported by evidence relevant to those factors.
