            Plaintiff wife sought review of the decision of the Circuit Court of Richmond (Virginia), which granted the wife and defendant husband a divorce. The wife contended that the chancellor erred by not granting her a divorce on the ground of adultery and that the chancellor's equitable distribution order and award of attorney fees were erroneous.

            The Virginia Court made the following holding:

  • One who alleges adultery must prove it by "clear and convincing" evidence independent of the parties' admissions. While a court's judgment cannot be based upon speculation, conjecture, surmise, or suspicion, adultery does not have to be proven beyond a reasonable doubt. Without evidence of the value of marital property, the chancellor can not make a monetary award. Va. Code Ann. § 20-107.3 requires that the party claiming entitlement to a monetary award for marital property present evidence from which the court can classify and value the property.
